The Supreme Court concluded the court session on the cassation appeal against the decision regarding sportsman Mehman Khalilov, who is accused of killing a seven-year-old child during training in Sumgayit.
Idman.biz reports with reference to "Pravda.az" that the decision was announced in the process chaired by Judge Rashad Abdulov.
According to the decision, the cassation appeal was not granted.
According to the indictment, on April 29, 2023, the city prosecutor's office received information about the death of Farid Bakarov, born in 2016, at the Sumgayit City Children's Hospital. During the initial investigation, there were reasonable suspicions that Mehman Khalilov, born in 1994, injured Farid Bakarov during a sambo training session at one of the schools in Sumgayit, resulting in the latter's death from those injuries.
A criminal case has been initiated in the Sumgayit City Prosecutor's Office under Article 126.3 of the Criminal Code (deliberately inflicting serious damage to health, resulting in the death of the victim through negligence).
Mehman Khalilov was detained as a suspect in the case.
It should be noted that a four-month detention measure was chosen for Mehman Khalilov in the Sumgayit City Court. While considering the submission, Mehman Khalilov stated that he did not consider himself guilty and was not responsible for the child's death.
Mehman Khalilov was initially found guilty under Article 120.2.4 of the Criminal Code (murder with special cruelty or by a generally dangerous method).
Later, he was charged under Article 120.2.9 of the Criminal Code (murder of a person who is clearly helpless to the perpetrator, as well as murder in connection with abduction or hostage-taking).
By the verdict of the Sumgayit Court of Grave Crimes, Mehman Khalilov was sentenced to 19 years of imprisonment. The Sumgayit Court of Appeal did not grant the appeal. At the hearing held in the Supreme Court, it was announced that the accused had withdrawn his cassation appeal.
