Today, "Sabah" FK became acquainted with the decision of the AFFA Player Status and Transfer Committee. According to this decision, the claims of the club's former football player Yusif Imanov were partially satisfied, while the club's counterclaims were not satisfied. The club believes that the Committee has come to a number of illegal and unfounded conclusions in this decision.
Firstly, the requirement of the regulations that the party in the case must send an official warning to the other party before submitting an application to the Committee and give a period for the execution of the requirements is not a formal procedure, but a legally important and mandatory requirement. Failure to comply with this requirement should exclude the acceptance of the footballer's claim for execution. However, the Committee's interpretation of this norm completely deprived the norm of its meaning.
Secondly, the Committee did not properly assess the main provision stipulated in the contract concluded between the football player and the club, which stipulates that the football player can play not only in the main team, but in any team (both the first and second teams).
If the transfer of a football player to the reserve team is regulated by contract, the sole authority to decide which players will play in the main and second teams belongs to the club and its coaching staff. The authority of the coaching staff in this matter cannot be limited. Thus, the argument that the footballer's removal from the main team is illegal cannot be legally accepted.
However, the Committee, without any legal basis, creates a dangerous precedent that the Committee, not the coaching staff, can decide in which team the footballer should play.
The Committee's decision is not final and "Sabah" FK will use all possible legal mechanisms to appeal this illegal, unfounded, biased and unfair decision.
